This product should be registered by replying to the order confirmation in the same manner that the product was received. [If the product was was shipped, return the completed registration card. If the product was supplied over the Internet, reply to the Email order confirmation after the product has been received, making note of the order confirmation date and product serial number (both required for technical support).
NOTE: BY ORDERING THIS SOFTWARE PACKAGE, THE END USER ACCEPTS ALL THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT. IF THE END USER DOES NOT AGREE WITH ALL THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT, THE PRODUCT SHOULD NOT BE ORDERED.Allowable Use (Single-User License): The term "Software" shall refer to all computer files and documentation included in this product package. The end user agrees to use the Software from this package solely for the end user's own use or business on at most two of the following devices: printers, imagesetters, film recorders, or other output devices which contain a PostScript® interpreter, and up to 5 workstations ("seats"). This restriction does not apply if the end user has obtained a Site License.
Ownership Rights and User Obligations: The contents of this Software package are the valuable property of Production First Software and its suppliers. Production First Software and its suppliers always retain ownership and title of this Software, including the documentation, any media supplied with the Software package, and all subsequent copies of the Software in any form. The end user does not own the Software or copies of the Software and software documentation supplied in conjunction with this Software package. The end user will not make or permit to be made any copies of the Software, its documentation, or any portions thereof, except to make one (1) backup copy of the Software or such copies as are necessary for the correct installation and operation of the Software in accordance with the terms of the License Agreement. If this Software package contains copies of otherwise equivalent Software on multiple media (different sized disks, different formats on same type media, CD-ROM disks, or optical disks) or otherwise equivalent Software in multiple data files, the end user must retain all sets, including those not used. The end user may not distribute, lease, loan, reassign, or rent the remaining media disks or data files. The end user also agrees not to modify, reverse-engineer, adapt, translate, decompile, decrypt or encrypt, disassemble, or create derivative works based on the Software, other than that necessary for correct installation and operation. Trademarks shall be treated and used according to accepted trademark practice.
Assignment Rights: Assignment of rights under this Agreement to a third party is permissible as long as the third party agrees in writing to be bound by the terms in this Agreement prior to the assignment and provided that all copies of the Software and its related documentation are transferred and any remaining copies not transferred are destroyed. Except as detailed above, the end user may not assign rights under this Agreement, or distribute, lease, loan, rent, or otherwise transfer the Software. The end user will agree that the Software will not be illegally used or transferred in any manner which may be against the provisions of the United States Export Administration Act.
Licensing Term: The license to use this Software is in effect until terminated by Production First Software. Production First Software has the right to terminate the end user's license Agreement for failure of the end user to comply with any of the licensing terms. Upon termination of the license Agreement, the end user will destroy the entire Software package, including supplied disk media, data files, and documentation, and all copies of them, and cease use of any trademarks or registered trademarks.
Limited Warranty: The Limited Warranty on Production First Software products is 90 days from the date of delivery on supplied media or through the Internet, according to a copy of the user's receipt or order conformation. The warranty is limited to replacement of faulty media and freedom from data errors due to faulty media. The end user must report all errors promptly to the supplier and return the Software package to the supplier, along with a copy of the applicable order receipt or confirmation, within the stated warranty period. Production First Software will then replace, or authorize the replacement of, the Software package in compliance with the stated warranty, provided that the Software package has not been subject to abuse or accidental damage or destruction. Software corruption resulting from transmittal problems through the Internet is not covered by Production First Software because it is the responsibility of the Internet Service Provider and/or the end user. However, Production First Software will endevor to provide the Software package by an alternate special routing or delivery mechanism if requested by the end user and at the end user's expense. PRODUCTION FIRST SOFTWARE DOES NOT MAKE ANY WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE PERFORMANCE OR RUSULTS OBTAINABLE FROM USING THIS SOFTWARE PACKAGE OR FROM THE INFORMATION OBTAINED FROM ANY COMPONENT OF THE PACKAGE, OR REGARDING FITNESS FOR A PARTICULAR APPLICATION OR PURPOSE. PRODUCTION FIRST SOFTWARE MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AS TO INFRINGEMENT OF ANY THIRD PARTY RIGHTS. THE ABOVE LIMITATIONS MAY NOT APPLY IN SOME STATES, PROVINCES, OR COUNTRIES. THIS WARRANTY GIVES THE END USER SPECIFIC LEGAL RIGHTS WHICH MAY VARY FROM STATE TO STATE, PROVINCE TO PROVINCE, OR COUNTRY TO COUNTRY. IN NO EVENT WILL PRODUCTION FIRST SOFTWARE BE LIABLE TO THE END USER FOR ANY DAMAGES AS A RESULT OF USING THIS SOFTWARE PACKAGE OR THE INFORMATION FROM ITS CONTENTS, SUCH DAMAGES INCLUDING BUT NOT LIMITED TO: LOST PROFITS OR SAVINGS, AND OTHER CONSEQUENTIAL OR INCONSEQUENTIAL DAMAGES.
End User Acknowledgement: END USER ACKNOWLEDGES READING THIS AGREEMENT AND UNDERSTANDING ITS CONTENT, AND THAT IT IS THE COMPLETE AND EXCLUSIVE AGREEMENT BETWEEN THE END USER AND PRODUCTION FIRST SOFTWARE, AND THAT IT SUPERCEDES ANY PRIOR ORAL OR WRITTEN AGREEMENTS MADE BETWEEN THE END USER AND PRODUCTION FIRST SOFTWARE.
Government End Users: Use, duplication, and disclosure is subject to restrictions set forth in the applicable ADP Schedule contract for acquisition under the terms of a GSA contract, or DFARS 252.227-7013 (c)(1)(ii) and 48 CFR 52.227-19 (c)(1) and (2), as applicable, along with restrictions set fourth in this Agreement for acquisition under the terms of a Civilian agency contract.
Site License - no-network: Site Licensing pricing is based on the single user license price of the Production First Software package and the number of output devices at one specific location only. Output devices are as described above. If a no-network license is obtained and workstations are connected by, or terminals are connected to, networks, then a Network Minimum Charge applies. If a customer has no network, the customer must purchase a "no-network" license. However, the customer can choose to pay the Minimum Network Charge in anticipation of a future network installation. If a customer converts from no network to a network, the customer must purchase a "network" license, unless the Minimum Network Charge is paid along with the "no-network" license at the time of purchasing the original license. No credit will be issued for an existing "no-network" license without the Minimum Network Charge.
Site License - network option: Site Licensing pricing is based on the single user license price of the Production First Software package and the number of workstations are connected by, or terminals ("seats") are connected to, networks. If a customer has one or more networks, the customer may choose to purchase either a "no-network" license with the Minimum Network Charge, or a "network" license. Credit can be applied for increasing the number of seats after the original purchase.
Bulk License: This applies to licensing a font library or font collection to an OEM for bundling with hardware or software products or to a developer for alpha and beta testing of the developer's products. Total pricing is based on the maximum number of copies of a Production First Software package licensed. Each platform format of the package must be separately licensed. The OEM may distribute copies of all or part of the standard documentation which comes with the package, together with the OEM's product only. The OEM may not distribute all or part of the standard documentation in any other manner without the express written permission of Production First Software.
