In the Orkney Archives Court Records SC11/5/1783 Archibald Learmonth Jnr, Merchant in Kirkhouse, Sanday was taken to court for debts due to William Watt Jnr & Co, Merchants in Kirkwall. This sum was for £1 - 9/5d from 18 Aug 1781 and 4/4d from 11 Sept 1783. Archibald failed to appear at the Tolbooth in Kirkwall for the trial, therefore the Sheriff discerned against him.
Another court record, SC11/5/1789, Archibald Learmonth, tenant in Clett, Sanday owed £7 14/- to James Heddle of Rennibuster, Firth, and was summoned to appear in the Tolbooth on 5 March 1789. He did not appear, therefore the Sheriff discerned against him. Not sure if this is the same Archibald.

Court records held in the Orkney Archives SC11/5/1817/66 was a claim for money owed to James Learmonth, Weaver, Sanday, by John Swanney, Silverhall, Sanday. The amount due was £14 - 13 /- and the case was due to be heard on 15 Jan 1818, but John Swanney did not appear, therefore judgement was made in James Learmonth's favour. The money due was later paid in full.

..giving them 40 days warning of removal from the premises. The Summons was served on 22 March 1834, to appear at the Tolbooth in Kirkwall on 3 April 1834. No-one appeared to defend the action, so the Sheriff discerned against them.
We know that James Learmonth was still at Whistlebare when he died in 1868, so perhaps an agreement was reached to allow this family to stay on in their home.

Mary died of consumption.
In Court Records SC11/5/1810/54 held in the Orkney Archives, Kirkwall, it was claimed by Agnes Drummond, that on 4 April 1810, Mary Scott had tethered her cow on ground containing short and blasted corn belonging to Walter Traill. On seeing her, Agnes sent her sister in law, Helen Scott, to request that she remove her cow, but she had refused. Agnes, being heavily pregnant, went along and tried to shorten the tether on the cow, but Mary, seeing this, set down a child she was carrying in her arms, picked up a stone and threw it at Agnes Drummond, striking her in the chest. Mary, then grabbed her hair, pulling her to the ground and continued to beat her, bruising her chest and back.
Helen Scott and Janet Burgher, witnessing the assault, rushed to Agnes assistance, at which point Mary went off. The complainer demanded that £20 plus expensed be paid in compensation by Mary Scott and her husband, James Learmonth and a trial was set for 13 March 1811, but the defenders did not appear. This was taken as a confession of guilt, but in respect of their poverty the complainers reduced their claim to 5 Guineas plus expenses.

This family were not living in Sanday at the time of the 1841 census .
A William Learmonth was served a Summons of Removal on 15 May 1835, which had been raised by James Drever, Merchant in Kirkwall, and Tacksman for the Traill Estate at Westove. At the time he was residing at West Thrave, Sanday and owed £14-8/7d in rent arrears since 1833. From a total rent due of £30-4/2d, he had paid £15-10/-, and had worked in the Turnips for seven days, earning 5/3d which was also deducted from his rent.
The Summons was dated 11 May 1835, and he was due to appear in the Tolbooth in Kirkwall on 28 May 1835. He did not appear, and this being an admission of guilt, the Sheriff discerned against him, also adding costs to his bill.
No house names were given in the 1841 census, but a Muir family were staying at West Thrave at the time of the 1851 census.
