On the legal front, JPMS
won a legal ruling involving the fight against diversion. In July,
the Superior Court in Orange County, California ordered a permanent
injunction against the diversion of Paul Mitchell Professional
Salon Products.
Ruling on JPMS breach of contract against Hair 2001,
a Westminster, California salon, the Court ordered the damages
sought by JPMS, including $25,000 in contractual and fraud damages,
an additional $23,621 for attorney's fees and investigation costs.
"We are delighted that the courts again have
upheld the validity of the Paul Mitchell salon agreement,"
said JPMS chief legal officer Michaeline Abate Re.
JPMS private investigator Ian Sitren traced Paul Mitchell hair care products to the two Southern California swap meets of the defendants, Hair 2001 owners Van Strickland, Dominique Nguyen and Hong Tran. The swap meet vendors relinquished the products and have agreed not to purchase or sell Paul Mitchell hair care products.
